Terms of service

1. Who these terms are between

These terms are an agreement between you and InZone, Inc., a Delaware corporation with its address at 1119 Kearney Street, San Francisco, California, United States ("Montu", "we", "us").

They apply when you use the Montu application to do paid work, to review other people’s work, or both.

If you do not agree to these terms, do not use Montu. There is nothing to pay either way.

2. What Montu is

Montu is a platform where people in emerging and frontier markets are paid to produce data: photographs, audio recordings, written text and judgements about other people’s work. That data is supplied to organisations that buy human-generated data, including companies building artificial intelligence systems.

Montu is not an employer. The work is task by task, you choose which tasks to accept, and nothing here creates employment, partnership, agency or a joint venture. You are responsible for your own taxes and for any permissions you need in your own country to do paid work.

3. Who can use Montu

You may use Montu if:

  • you are at least 18 years old, or the age of legal majority where you live, whichever is higher;

  • you have a mobile phone number in a country where Montu operates;

  • you are able to receive money through one of the payout methods Montu supports in your country;

  • you are legally permitted to do paid work where you live.

One person, one account. An account is tied to the phone number that created it.

You may not create an account for anyone else, allow anyone else to use yours, or hold more than one account.

4. Joining

You join by giving your phone number and entering a code we send to it by SMS.

You then give consent, which records what data we collect and why, and you give the account where you want to be paid.

Your payout account is set once, when you join. After that, only Montu can change it, and only after verifying the request with you by phone. This protects you: it means that if someone gets access to your account, they cannot redirect your money. If your payout details genuinely change, contact us by email.

Every change to a payout account is recorded, with who made it and why, and the latest change is shown to you in your wallet.

5. Qualification

Before you can do paid task work in a language, you complete a sample task in that language.

The sample is paid. We do not ask anyone to work for free.

You get at most two paid attempts at the sample in any given language, and the second only if the first was rejected in review. If the second is also rejected, that language is closed to you.

A sample that fails the automatic checks is not paid, because it was never accepted as work. You can submit again in that case; it does not count as an attempt.

6. The work

6.1 Terms are frozen when you start

When you press Start on a job, the price, the currency and the exchange rate are fixed for that job. They do not change afterwards, whatever happens to our prices in the meantime.

The job is held for you for a stated period. If you submit after that period and after any grace window, the submission is refused. A refused submission is recorded and you can contact us about it.

6.2 What a job asks for

Each job states what it asks for and the specific reasons work may be rejected. Those reasons are the standard your work is judged against, and nothing else is.

Some jobs ask for a code to be visible in a photograph. That code is issued when you start the job and proves the photograph was taken afterwards. You get a limited number of attempts per job. When they are used, the job ends. A job that ends this way does not count against any limit on how much work you can take.

6.3 Automatic checks

Work is checked automatically when you submit it, for things like length, duplication, legibility and whether a recording contains sound. These checks are run by our servers on the file you sent, not on what your phone reports about it.

Work that fails an automatic check is rejected and is not paid.

6.4 Review

Depending on the job, work that passes the automatic checks may then be reviewed by other workers, by Montu, or by an expert we contract.

Reviewers do not know whose work they are reviewing. Workers who have reviewed each other cannot verify each other’s work on their own.

Each piece of work records how it was verified, and that record is supplied to the buyer with the work.

6.5 Limits

We may limit how much work any one person can take from a job, how much a job costs in total, and how much work is available in a market. These limits exist so that work is spread across people and so that we do not commit money we do not have.

7. Money

7.1 When you are owed money

You are owed the frozen price for a piece of work when the event stated for that job occurs. Depending on the job, that is when the work passes the automatic checks, when it is verified, or when the buyer accepts it. The job screen says which before you start.

7.2 When you are paid

Money owed to you is paid out when your balance reaches the payout threshold for your market, or sooner where the job says so.

During early phases of a market, payouts may be made by hand rather than automatically. Your wallet shows what is owed and what has been paid, and these are different things. Money shown as owed has been earned and will be paid.

7.3 We do not take money back

Once you are owed money for a piece of work, we do not claw it back. If the work is later rejected, audited, or disputed by a buyer, that affects future work, not money already owed to you.

7.4 Rejected work

Work rejected for failing the stated standard is not paid, except where the job states a floor payment for conforming work a buyer declined to take.

7.5 We never charge you

Montu never charges you to work, to join, to qualify, to withdraw money, or for anything else. Nobody acting for Montu will ever ask you for money, for a fee, for a deposit, or for your payout account’s password or PIN. If anyone does, it is not us. Tell us by email.

7.6 Transfer costs and exchange rates

Where a payout is made in a currency other than the one your work was priced in, the exchange rate used is stated with the payout. Your payment provider may charge you its own fees, which are outside our control.

8. Appeals

If your work is rejected on the grounds that it did not follow the job’s standard, you can appeal.

An appeal is read by a person at Montu. If it is overturned, the work is treated as verified and you are paid, including where a buyer had already declined it.

Appeals are decided once.

9. Reviewing other people’s work

If you are eligible to review, you may be paid to judge other people’s work against the stated standard.

Review is blind. You will not be told whose work you are reviewing.

You may not review work by someone you know personally, by someone in your own referral chain, or by anyone you have arranged with to review each other’s work.

A reviewer who passes work that later fails an audit loses the reputation gained from that review and may be flagged.

Review fees are owed when the outcome of the review is decided.

10. Who owns the work

You keep no rights in the data you produce for Montu.

By submitting work, you assign to Montu all rights in that work, including copyright, worldwide and for the full term, so that it can be supplied to buyers and used by them.

You confirm that the work is yours, that you made it for this job, and that it does not infringe anyone else’s rights.

For photographs: you confirm that you had the right to take the photograph where you took it, and that it does not show a person who has not agreed to appear in it. Do not photograph people. Do not photograph private property, military or government installations, or anywhere photography is prohibited.

For recordings: you confirm the recording is of your own voice unless the job says otherwise, and that you have the agreement of anyone else audible in it.

For written work: you confirm it is your own writing and was not produced by a machine translation or generation tool, where the job says so.

11. Your reputation and tier

Montu records a reputation score and a tier for each account, based on work accepted and rejected, reviews that matched the outcome, and audits.

Your tier determines what work you can take and whether you can review.

12. Fraud and suspension

We may flag or suspend an account where we see, among other things:

  • more than one account on one payout destination;

  • work submitted far faster than the task takes;

  • uploaded files that were not captured for the job;

  • duplicate or near-duplicate work;

  • reviewers arranging to pass each other’s work;

  • any attempt to defeat the checks described in these terms.

A flagged account can keep working while the flag is open. A flag is closed by a person at Montu, with a recorded reason.

A suspended account cannot take new work. Money already owed for accepted work is still owed and is still paid.

13. Availability

Montu is provided as it is. We do not promise that work will be available in your language or market, that the application will be available without interruption, or that your work will be accepted.

Work available at one moment may be taken by someone else before you start it.

14. Changing these terms

We may change these terms. Where a change affects your rights, we will tell you and ask you to agree before you take new work.

A change never affects work you have already started or money already owed to you. Terms frozen when you started a job stay frozen.

15. Ending the agreement

You can stop using Montu at any time. Money owed to you for accepted work is still paid.

You can ask us to close your account. See the privacy policy for what happens to your data, and note that work already supplied to a buyer cannot be recalled from them.

We can end this agreement with you if you breach these terms.

16. Liability

To the extent the law where you live allows it:

  • Montu’s total liability to you for any claim is limited to the amount we owed you in the three months before the claim arose;

  • we are not liable for indirect or consequential losses, lost earnings, or loss of expected work;

  • nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Nothing here takes away rights you have under the law of your own country that cannot be contracted away. Where these terms conflict with such a right, that right applies.

17. Governing law and disputes

These terms are governed by the law of the State of Delaware, United States.

This does not take away the protection of the mandatory law of the country where you live. If you are in Indonesia, Nigeria or Kenya, your rights under that country’s consumer and data protection law apply regardless of this clause, and you may bring a claim in your own country’s courts where that country’s law gives you that right.

Before any formal dispute, contact us by email. Most problems are a payment or a rejection and are settled directly.
